Liability of issuers of crypto-assets

When a crypto-asset issuer has provided white paper information that is not complete, objective, clear, or misleading, the holder of the crypto-asset can sue for damages.

Prior limitation of the issuer's liability is not permissible.

The holder must prove that there were violations in the content and form of the white paper of the crypto-asset and that this had an impact on the decision to buy, sell and exchange the asset.

If the white paper summary is misleading, inaccurate, inconsistent, or does not provide the most important information, the holder of the crypto asset has the right to file a claim for damages.

The Regulation does not exclude a claim provided for in national law.
